Terms of Service

These Terms of Service ("Terms") govern your use of totalminisplit.com (the "Site") and the services offered by Total Mini Split, a trade name of TruFicient Energy Solutions ("Total Mini Split," "we," "us" or "our"). By using the Site, requesting an estimate, booking a site visit or making a purchase, you agree to these Terms.

1. Our services

Total Mini Split sells ductless mini split heating and cooling systems with professional installation only. We do not sell equipment or accessories for do-it-yourself installation. All installations are performed by a licensed HVAC contractor (the "installer of record"). At this time the installer of record is TruFicient Energy Solutions, a Mitsubishi Electric Diamond Contractor, TDLR License TACLB77247C.

2. Online estimates

Prices shown by our online estimator are estimates based on the information you provide. They are not a final price. Your final price is set in a written quote after a site visit, which may include items such as additional line set, electrical work, condensate pumps, mounting changes, permits or access requirements.

3. Site visit fee

The site visit fee is $25, paid online when you book and credited toward your installation if you move forward with the job. For now we are waiving the site visit fee, so booking a site visit is free. If the fee applies again, the amount due is shown before you book. When a fee is charged: if we determine we cannot perform the installation, the site visit fee will be refunded; if you choose not to proceed after the visit, the fee is non-refundable.

4. Quotes, deposits and payment

• After the site visit we provide a written quote. The quote is valid for the period stated on it.
• A deposit of 50% of the quoted price is due to schedule your installation and order equipment.
• The remaining balance is due when installation is complete.
• Payments are processed through OttoPay. By paying, you also agree to the payment provider's terms.
• Prices and availability of equipment may change before a quote is accepted.

5. Scheduling, cancellations and changes

Installation dates are scheduled after your deposit is received and equipment is available. If you cancel after equipment has been ordered, you may be responsible for non-refundable equipment costs and restocking fees, as stated in your quote or installation agreement. Changes to the scope of work after acceptance may change the price.

6. Your responsibilities

You agree to provide accurate information, safe access to the work areas and outdoor unit location, and to confirm you have authority to approve work at the service address (for example, as owner or with the owner's permission). Homeowners association and landlord approvals are your responsibility unless we agree otherwise in writing.

7. Permits

Where required, permits are pulled by the installer of record and permit fees are included in your quote.

8. Warranty

• Parts: Manufacturer parts warranty per the manufacturer's terms when the equipment is registered. Mitsubishi Electric systems installed by a Diamond Contractor qualify for a 12-year parts and compressor warranty when registered.
• Labor: 2 years of labor coverage on our installation workmanship.
• Extended labor: An optional 12-year labor warranty may be purchased at checkout.

We register your equipment warranty on your behalf. Warranty coverage does not apply to damage from misuse, lack of maintenance, power surges, acts of nature, or work performed by others. Warranty claims are submitted through your Total Mini Split account or by contacting us. Full warranty terms are provided with your installation agreement.

9. Text messaging program (SMS)

Program name: Total Mini Split Customer Messages

What you'll receive: If you opt in, Total Mini Split (a trade name of TruFicient Energy Solutions) will send text messages from (817) 552-3680. These include one-time login passcodes, appointment confirmations and reminders, scheduling updates, and customer care messages about your estimate, project, payments and service.

How to opt in: Check the SMS consent box on our estimate, site visit booking or account signup form, text START to (817) 552-3680, or scan one of our QR codes, which opens a text to that number.

Frequency: Message frequency varies by your project, typically a few messages per week during an active job.

Cost: Message and data rates may apply.

Opt out: Reply STOP to any message to unsubscribe. You will receive one final message confirming you are unsubscribed. You can re-subscribe by texting START.

Consent: Consent to receive text messages is not a condition of purchase.

Carriers: Mobile carriers are not liable for delayed or undelivered messages.

Privacy: We do not share or sell your mobile number or SMS consent with third parties for marketing. See our Privacy Policy.

10. Use of the Site

You agree not to misuse the Site, including by submitting false information, attempting to access accounts or systems without permission, interfering with the Site's operation, or scraping content. Site content, including text, photos and graphics, belongs to Total Mini Split or its licensors and may not be copied without permission. Product names and trademarks belong to their owners.

11. Disclaimers

The Site and its content, including estimator results, sizing suggestions and educational articles, are provided "as is" for general information. Energy savings, rebates and incentives are not guaranteed and depend on your home, usage and program rules.

12. Limitation of liability

To the fullest extent allowed by law, Total Mini Split will not be liable for indirect, incidental, special or consequential damages arising from use of the Site. Our total liability for any claim related to the Site is limited to the amount you paid us for the service giving rise to the claim. Nothing in these Terms limits rights you have under Texas law that cannot be waived.

13. Governing law

These Terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts located in Dallas County, Texas, unless otherwise required by law.

14. Changes to these Terms

We may update these Terms. The "Last updated" date above shows when they last changed. Continued use of the Site after changes means you accept the updated Terms. The terms in your signed quote or installation agreement control for that job.
